Welcome to PlayPeak! The terms “we”, “us” and “our” refer to PlayPeak operated by Distream OU (Estonian company registration number: 16319092, VAT no.: EE102414905, registered office: Sakala tn 7-2, 10141 Kesklinna linnaosa, Tallinn, Harju maakond, Eesti , email: info@playpeak.ee, phone: +372 58855058).
PlayPeak operates this website and online store, including all related information, content, features, tools, products and services (the “Services”). PlayPeak is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with our Privacy Policy and Refund Policy (collectively, the “Terms”), describe your rights and obligations when you use the Services. Please read them carefully. By using our Services, you agree to be bound by these Terms.
1. Access and Account
You must be at least 18 years old (or the age of majority in your country) to place an order.
You agree to provide accurate and complete information when creating an account or making a purchase.
You are responsible for keeping your account credentials secure.
2. Products and Availability
We make every effort to display our products accurately. However, colors and appearance may vary depending on your device.
All product descriptions and prices may change without notice.
We reserve the right to discontinue products or limit quantities.
3. Orders and Contract Formation
By placing an order, you make an offer to purchase.
A binding contract is formed only when we confirm acceptance by sending you an order confirmation email.
If a product is unavailable, we will inform you and refund any payment.
4. Prices and Payment
Prices are shown in euros (EUR) and include VAT where applicable.
Shipping, handling charges are shown before checkout.
We accept payment by the methods displayed at checkout.
By providing payment details, you confirm you are authorised to use the chosen payment method.
5. Shipping and Delivery
Estimated delivery times are provided at checkout but are not guaranteed.
For consumers in the EU: risk of loss or damage passes only when you (or someone you designate) physically receive the goods.
For business customers, risk passes when goods are handed to the carrier.
6. Right of Withdrawal (Consumers Only)
If you are a consumer in the EU, you have the right to withdraw from your purchase within 14 days without giving any reason.
The withdrawal period expires 14 days after you receive the goods.
To exercise your right, you must inform us by email at info@playpeak.eu, clearly stating your decision to withdraw.
You may also use the EU Model Withdrawal Form (Annex I of Directive 2011/83/EU).
Refunds:
If you withdraw, we will refund all payments received (including standard delivery costs) within 14 days of being informed, using the same payment method you used.
We may withhold the refund until we have received the goods back or proof of return.
Returns:
You must return the goods to us at your own cost (unless we delivered them incorrectly or they are defective).
Goods must be returned in their original condition and packaging, where possible.
Exclusions:
The right of withdrawal does not apply to goods that are:
made to your specifications or clearly personalised;
sealed goods which are not suitable for return for health protection or hygiene reasons if unsealed after delivery;
digital content after download has begun with your prior consent.
7. Legal Warranty
All goods purchased by consumers in the EU are covered by a two-year legal guarantee under the Estonian Law of Obligations Act.
If your goods are faulty, you are entitled to free repair, replacement, price reduction or refund.
8. Intellectual Property
All content on our Services (trademarks, logos, text, graphics, images, layouts, etc.) is owned by PlayPeak OĂś or its licensors and protected under intellectual property laws. You may use the Services for personal, non-commercial purposes only.
9. Third-Party Services and Links
We may provide links or access to third-party websites or tools. We are not responsible for such third-party content, and your use is at your own risk.
10. Privacy and Personal Data
PlayPeak is the data controller for personal data processed via this store.
We process personal data as necessary to perform your order, manage your account, and comply with legal obligations.

11. Limitation of Liability
We are responsible for providing products and services in accordance with applicable law. Nothing in these Terms affects your legal rights as a consumer.
For business customers, we exclude liability for indirect or consequential damages, including lost profits or data.
12. Termination
We may suspend or terminate your access to the Services if you breach these Terms. You remain responsible for obligations incurred before termination.
13. Governing Law and Disputes
These Terms are governed by Estonian law.
Consumers: you may bring disputes in Estonian courts or in the courts of your EU member state of residence. You may also use the EU Online Dispute Resolution (ODR) platform.
Business customers: disputes will be subject to the jurisdiction of the Estonian courts.
14. Changes to Terms
We may update these Terms from time to time. Any changes will apply only to future orders. Material changes will be notified on our website.
